Tipping servers and take-out deliverers
It is customary to tip servers while dining-in, while picking up take out and when receiving a take-out delivery at home. With dining-in no longer an option during the pandemic, servers are losing a significant amount of tips. Now, due to COVID19, workers of restaurants doing deliveries depend on your tips even more.
Minimum Wage Laws
- The minimum wage in Arizona is $12 an hour, but as of 2020. Arizona law allows employers to count tips as part of a server’s hourly wage. This means servers can be paid as little as $9 an hour, as long as they earn at least $3 in tips per hour to bring their compensation up to at least $12 an hour, total.
- If a server does not make at least $3 in tips per hour, they are entitled to earn the full minimum wage. An employer is legally obligated to make up for those missing tips by adding that difference to the employee’s paycheck. However, it’s common within the industry for this law to not be followed or enforced and employees often make less than minimum wage.
Tip Basics
- The basic rule of tips, under federal and Arizona law, is that they belong to the employee, not the employer. Employers can’t require employees to hand over their tips unless the establishment has a tip pool.
- Under federal law and in most states, employees can be required to pay part of their tips into a tip pool to be shared evenly with other employees.
